The following terms and conditions (βPack Terms and Conditionsβ) shall apply to the Tune Talk Epik Data SIM Pack (the βPackβ). These Pack Terms and Conditions are supplementary to and shall be read together with the Tune Talkβs Service Subscription Terms and Conditions, Privacy Policy, Fair Usage Policy and other applicable terms andΒ Β conditions issued by Tune Talk (collectively, the βGeneral Termsβ). In the event of any inconsistency between these Pack Terms and Conditions and the General Terms, the General Terms shall prevail to extent of such inconsistency.
Definitions
βPackβ means a SIM card issued by Tune Talk bundles with a pre-defined data entitlement and validity, sold as a packaged product through Tune Talkβs authorised distribution channels.
βSubscriberβ means any end-user who inserts, activates, or uses the Pack.
βActivationβ means the first usage of data, or the first network attachment of the SIM card, whichever occurs earlier.
βCycleβ means a 30-day validity period applicable to each data entitlement under the Pack.
Plan Description
The Pack is offered in the following variants:
Epik Data SIM Pack (1-Month): RM10, inclusive of 2GB high-speed data, valid for one (1) Cycle commencing from Activation.
Epik Data SIM Pack (12-Month): RM99, inclusive of 2GB high-speed data per Cycle for twelve (12) consecutive Cycles commencing from Activation.
In the event that the data quota is fully utilized, subscriber may purchase an additional 5GB data booster for RM5.
All charges are quoted in Ringgit Malaysia (RM) and are inclusive of applicable Sales and Service Tax (SST).
Activation and Validity
The validity period for the Pack shall commence immediately upon Activation.
For the twelve (12) month Pack, the data entitlement shall refresh automatically at the commencement of each Cycle until all twelve (12) Cycles have been utilised.
Unused data at the end of each Cycle shall be forfeited and shall not be carried forward.
Lifecyle and Expiry
Upon expiry of the validity period, the Subscriberβs line shall transition to a thirty (30) day grace period (βGrace Periodβ).
During the Grace Period, the Subscriber may repurchase or extend the service. Data usage shall not be available unless and until such repurchase or extension is successfully completed.
Failure to repurchase or extend within the Grace Period shall result in the SIM card and associated service being permanently terminated (βExpiredβ). An Expired SIM card cannot be reactivated, and a new Pack must be purchased.
Repurchase and Stacking
Subscribers may repurchase the Pack through the designated Tune Talk portal or by scanning the QR code provided with the Pack.
Multiple purchases shall stack sequentially, with the next Cycle commencing upon the expiry of the current Cycle.
Repurchase shall only be permitted where the SIM is in Active or Grace Period status. Expired SIM cards shall not be eligible for repurchasing.
Upon the first repurchase attempt of the Pack, the Subscriber shall be required to complete electronic Know-Your-Customer (eKYC) verification as mandated by the Malaysian Communications and Multimedia Commission (MCMC).
The repurchase process and service continuation shall only proceed upon successful completion of the eKYC verification.
Tune Talk reserves the right to suspend, deny, or terminate the service if the Subscriber fails to complete or does not pass the eKYC verification process.
SIM Replacement
In the event of SIM card loss, damage, or defect, the Subscriber may request a SIM replacement through Tune Talk Customer Care.
Upon successful verification and replacement, the remaining validity and any unutilised data entitlement associated with the original SIM shall be transferred to the replacement SIM.
Tune Talk reserves the right to impose a replacement fee and to require such verification or documentation as it deems appropriate.
SIM replacement requests shall only be accepted while the original SIM is active or within the Grace Period. Expired SIMs shall not be eligible for replacement or data transfer.
Device Compatibility and Partner Responsibility
The Pack is intended for use in a single compatible device only (including but not limited to routers, CCTV equipment, tablets, and IoT devices).
The Subscriber shall ensure that the device used is compatible with the Tune Talk/CelcomDigi network.
Tune Talk shall not be responsible or liable for the quality, warranty, or performance of any third-party devices with which the Pack is bundled. Such responsibility shall rest solely with the respective device manufacturer or distributor.
Service Quality and Fair Usage
Service is provided on a best-effort basis and may vary by coverage, device, or network conditions.
Tune Talkβs Fair Usage Policy shall apply. Tune Talk reserves the right to take any necessary measures, including but not limited to traffic management or speed control, in order to maintain overall network quality and integrity.
The Pack is a data-only service. Voice, SMS, international roaming, and IDD services are not available.
Charges and Refunds
All charges are non-refundable once the transaction is completed, except where expressly required by law.
No refunds shall be made in respect of unused data, partially used Cycles, or Expired SIM cards.
In the event that a Subscriber is charged but the Pack is not provisioned, the Subscriber shall be required to contact Tune Talk Customer Care with proof of transaction for verification and rectification.
Suspension and Termination
Tune Talk reserves the right, at its sole discretion, to suspend or terminate the Pack or service in the event of:
suspected fraudulent, abusive, or unlawful use;
breach of these Pack Terms and Conditions or the General Terms; or
directive by law or regulatory authority.
Personal Data
Any personal data collected in connection with the Pack shall be processed in accordance with Tune Talkβs Privacy Policy, available on Tune Talkβs official website.
By purchasing or using the Pack, the Subscriber is deemed to have consented to such processing.
Governing Law and Jurisdiction
These Pack Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.
The Subscriber agrees to submit to the non-exclusive jurisdiction of the courts of Malaysia.
